Joint Guidelines by the Ministry of Commerce, Ministry of Foreign Affairs, NDRC, MIIT, and SASAC on Enhancing China’s Overseas Integrated Service Framework

With the goal of enhancing the international competitiveness of enterprises going global and safeguarding their legitimate rights and interests overseas, we adhere to the principle of balancing development and security, and promote the high-quality supply and efficient matching of service resources in a coordinated manner. We aim to create a three-dimensional, full-chain overseas comprehensive service ecosystem featuring central and local collaboration, regional coordination, resource aggregation, and internal and external integration. Ii. Optimizing and Improving Public Platforms and Services (1) Building a national-level comprehensive service platform. Integrate service resources in fields such as foreign affairs, law, finance and taxation, finance, economy and trade, logistics, customs, and trade promotion, upgrade the "going global" public service platform to a national-level comprehensive overseas service platform, covering the entire process and chain of enterprises' overseas expansion, and connect platform resources such as "Tax Road Pass", "Trade Law Pass", treaty database, and national overseas intellectual property information service. Form a "1+N" service system that organically combines a comprehensive service platform and specialized service sub-platforms. Centering on the common demands of enterprises going global, enhance the integration, comprehensiveness and digitalization of the platform. Expand the functions of the national network system for overseas investment management and services. (2) Provide high-quality public goods. Guide enterprises to make good use of existing public products such as country (region) guidelines for foreign investment and cooperation, country trade guidelines, and business environment reports of key countries (regions), and innovatively launch more public products that are highly timely and practical. More refined and targeted training and exchange activities will be launched around market expansion, compliance operation and management, risk prevention and response, intellectual property protection, anti-monopoly compliance, and overseas rights and interests protection for enterprises going global. Strengthen risk warnings for enterprises going global, provide timely policy consultation, and guide enterprises to safeguard their legitimate rights and interests overseas. (3) Enhance the efficiency of comprehensive services. Promote the application of electronic certificates and licenses to enhance the efficiency of filing (approval) for outbound investment and the level of digital governance. Carry out regular communication and exchanges, and improve the rapid response mechanism for enterprises' demands. Encourage and support national industry associations to play a coordinating role, and make use of events such as the China International Import Expo, the China Import and Export Fair, and the China International Fair for Investment and Trade to help enterprises more conveniently and efficiently connect with high-quality global service resources. Iii. Integrated Innovation of Local Services (4) Upgrading Online and Offline Services. Guide local authorities to strengthen the construction of "online + offline" service channels in their regions in accordance with local conditions, and create a "one-stop" window for enterprises to obtain basic information when going global. Relying on local government service centers, we will continue to optimize the procedures for handling business related to enterprises' foreign investment, foreign trade, and personnel entry and exit. Gather high-quality professional service institutions in fields such as legal services, intellectual property rights, financial accounting, security protection, financial services, and human resources, and optimize and strengthen service brands with regional characteristics. (V) Explore innovative service models. Encourage localities with the necessary conditions to rely on free trade pilot zones, free trade ports, and national comprehensive demonstration zones for expanding the opening up of the service sector, etc., to leverage their advantages as open hubs, headquarters economies, and service resources, proactively align with international high-standard economic and trade rules, carry out pioneering and integrated explorations, and build comprehensive service ports for going global. Support localities in promoting high-quality services in various industries and fields in appropriate forms to help enterprises effectively identify and precisely match overseas service resources. Support the complementary advantages of regions such as the Beijing-Tianjin-Hebei region, the Yangtze River Delta, and the Guangdong-Hong Kong-Macao Greater Bay Area, efficiently integrate high-quality service resources, and form a synergy effect. Relying on the advantages of Hong Kong and Macao in cross-border investment and trade, finance, law and other fields, we will expand economic and trade cooperation mechanisms, strengthen the linkage of service institutions, and jointly enhance the ability to serve enterprises going global. Iv. Extending and Improving Overseas Services (6) Expanding the functions of Overseas economic and trade cooperation zones. Based on the principles of equality and mutual benefit, reasonable layout, appropriate scale and gradual progress, support will be given to leading enterprises going global to participate in the construction of overseas economic and trade cooperation zones (hereinafter referred to as cooperation zones). Strengthen policy communication with the host country to create a stable and predictable business environment for the development of enterprises entering the zone. (7) Establish overseas comprehensive service stations. Encourage qualified overseas Chinese-funded enterprises, business associations, cooperation zones, and Chinese-funded legal service institutions to establish overseas comprehensive service stations in key countries and regions, assist enterprises in meeting their on-site service needs, and provide continuous services for enterprises going global to build international marketing networks and expand overseas markets. V. Strengthening Economic and Trade Cooperation Guarantees (8) Enriching bilateral Cooperation mechanisms. We will promote the signing of bilateral cooperation documents with more countries and regions in areas such as jointly building the Belt and Road Initiative, investment, trade, taxation, social security, intellectual property protection, judicial assistance and anti-monopoly, and enrich the institutional guarantees for services related to enterprises. Better leverage the role of bilateral economic and trade cooperation mechanisms and promptly respond to the service demands of enterprises going global. (9) Create a safe and favorable environment. Strengthen the tracking and release of overseas security risk information, guide enterprises to improve risk assessment and response, safeguard the legitimate rights and interests of Chinese citizens and legal persons overseas, and provide protection and help solve problems for enterprises going global. (10) Properly handle investment and trade disputes. Make good use of diversified dispute resolution mechanisms such as mediation and arbitration to enhance the ability to deal with legal disputes abroad. Support industry organizations and enterprises in comprehensively applying measures such as legal defense and judicial litigation to enhance their ability to properly handle trade frictions. Vi. Expanding and Enhancing Professional Services (11) Improve the service levels of law, finance and accounting, consulting, etc. Enhance the international service capabilities of law firms and arbitration institutions, and cultivate world-class law firms and arbitration institutions. Support accounting firms in providing services such as accounting audits, evaluations, due diligence, and financial and tax advisory services, and expand cross-border businesses such as audit verification and supply chain management. Guide consulting firms to provide services such as global development strategy coordination, corporate governance, marketing design, and brand promotion for enterprises going global, helping them climb to the high end of the value chain. Encourage legal, financial and accounting, and consulting institutions to integrate resources from related industries and provide systematic solutions for enterprises going global. (12) Enhance the cross-border service capabilities of financial institutions. Encourage policy-based and commercial financial institutions to improve their service products and methods within their business scope based on their functional positioning, and expand financing channels for enterprises. Guide financial institutions to optimize their overseas layout and provide customized and "follow-up" services for enterprises. Encourage insurance institutions to expand their underwriting scale and coverage, develop insurance types that meet the needs of enterprises going global, and actively carry out reinsurance business. (13) Expand various professional service fields. Encourage service institutions in the fields of information technology and others to innovate their service methods and empower overseas enterprises with digitalization. Encourage intellectual property, standard inspection and certification, human resources and other service institutions to enhance their international service capabilities, actively participate in the formulation of relevant international standards and rules, and carry out international exchanges and cooperation. Explore the alignment of professional qualification certifications between China and foreign countries to enhance the international recognition of professional qualifications for relevant technical personnel. Support the construction of relevant expert think tanks to provide intellectual support for enterprises. Vii. Enhancing the Capabilities of Enterprises Going Global (14) Strengthening the Cross-border operation capabilities of enterprises. Strengthen the training of international operation and management for enterprises going global, and promote their understanding and mastery of international common rules and business practices. Guide overseas enterprises to scientifically formulate international development strategies, conduct in-depth feasibility studies on overseas investment and operation, and enhance the level of global operation and management. Support enterprises going global in strengthening the cultivation of talents for cross-border operations, and build professional teams with an international perspective and cross-cultural communication skills, who are familiar with domestic and international legal rules and specific country markets. (15) Strengthen the alignment of international rules and concepts. Strengthen cooperation with multilateral institutions and promote mutual understanding and compatibility with international common rules, regulations, management and standards in the economic and trade fields. Guide enterprises to focus on localized operation, actively fulfill social responsibilities, shape a good international brand image, integrate enterprise development with local social development, and achieve a win-win situation and sustainable development for shareholders, employees, suppliers, customers, the host government, local communities and the ecological environment. (16) Enhance the compliance level of overseas operations. Encourage relevant service institutions to enhance enterprises' awareness of compliance in overseas operations through offline training and other means. We will promote the development of various foreign-related legal service institutions in a coordinated manner and provide enterprises with all-round compliance consulting services. To further improve the comprehensive overseas service system, it is necessary to uphold and strengthen the Party's overall leadership and implement it throughout the entire process and all aspects of work. All regions and relevant departments should fully recognize the significance of further improving the overseas comprehensive service system from a global and strategic perspective. Under the premise of safeguarding the red line of safe development, they should give full play to the role of relevant working mechanisms, strengthen interdepartmental collaboration and internal and external linkage, enhance the efficiency of overseas comprehensive services, and achieve high-quality supply and efficient matching of overseas service resources. Provide strong support for overseas enterprises to participate in international cooperation and competition.
